Amend The Constitution

Course Description:

Everybody has a solution for amending the Constitution and creating better government – term limits, restrictions on campaign funding, and requirements that our representatives be restricted by the same legislation that the people are. Deeper analysis of all of these schemes suggests they are like taking aspirin to cure cancer. Meanwhile a very simple solution is available – prevent the expansionist interpretation of the general welfare phrase in Article I, Section 8 of the Constitution. General welfare has been used by Congress to justify otherwise unconstitutional legislation, including ObamaCare. The expansionist interpretation of the Constitution effectively nullifies it. But the argument about the expansionist interpretation is not really new – its roots lie in an initial constitutional argument between the Federalists and the Anti-federalists. Madison dismissed the expansionist interpretation as an “absurdity”, but in this case the Anti-federalists were right.
